У статті на основі застосування порівняльно-правового методу проаналізовано окремі норми законів України «Про Державне бюро розслідувань», «Про оперативно-розшукову діяльність», «Про Національну поліцію», «Про прокуратуру», «Про Службу безпеки України», на основі чого визначено місце Державного бюро розслідувань (далі – ДБР) серед інших центральних органів виконавчої влади. На перший погляд здається, що існує конфлікт інтересів або конкуренція компетенції ДБР та окремих інших державних адміністративних та контролюючих органів, оскільки сьогодні близько двадцяти з них проводять оперативно-розшукову діяльність та здійснюють досудове слідство. Показано, що конкуренція в компетенції з прокуратурою в ДБР відсутня через здійснення першою не оперативно-розшукової діяльності, а нагляду за дотриманням законності службами й підрозділами, що проводять оперативно-розшукову діяльність (серед яких і ДБР), а фахівці ДБР мають повноваження на документування вчинення злочинів прокурорами Спеціалізованої антикорупційної прокуратури. ДБР та Національне антикорупційне бюро України (далі – НАБУ) можуть документувати та розслідувати злочини співробітників один одного. Найбільш конкурентними є компетенція ДБР із компетенцією окремих підрозділів Служби безпеки України (далі – СБУ) та Національної поліції. Найвищу соціальну небезпеку становлять злочини, які документуються та розслідуються підрозділами СБУ; більш високу небезпеку становлять злочини, які документуються та розслідуються підрозділами ДБР, а не Національною поліцією. Тому, виходячи з аналізу норм названих вище законів України, указано на можливість передачі матеріалів та/або кримінальних справ від підрозділів Національної поліції до підрозділів ДБР та СБУ і передачі матеріалів від підрозділів ДБР до підрозділів СБУ. Зважаючи на відносно невисоку граничну чисельність центрального апарату та територіальних управлінь ДБР (1500 осіб), а також на перші результати й активність їхньої роботи, зроблено висновок, що ДБР уже має власну нішу в системі аналогічних центральних органів виконавчої влади й повинне виправдати витрати Державного бюджету на своє утворення та функціонування.
The paper employs a comparative legal method to analyze certain provisions of the laws of Ukraine «On the National Bureau of Investigation», «On Law Enforcement Intelligence Operations», «On the National Police», «On the Prosecutor’s Office», «On the Security Service of Ukraine», thus determining the place of the National Bureau of Investigation (NBI) among other central executive agencies. On the surface, it seems that there is a conflict of interest or competition between the competence of the NBI and other state administrative and supervisory agencies since today about 20 of them carry out law enforcement intelligence operations and pretrial investigation. The paper shows that the prosecutor’s office and the NBI do not have competition in the competence because the prosecutor’s office does not carry law enforcement intelligence operations but oversees the compliance with laws on the part of the services and units engaged in law enforcement intelligence operations (including the NBI), and the employees of the NBI have the authority to keep records of committed crimes by prosecutors of the Specialized Anti-Corruption Prosecutor’s Office. NBI and National Anticorruption Bureau of Ukraine (NABU) can keep records and investigate crimes committed by each other’s employees’. The most competitive is the competence of the NBI with the competence of individual subdivisions of the SSU and the National Police. Crimes that are documented and investigated by the SSU units represent the highest social danger; crimes documented and investigated there by the NBI units represent a higher risk as compared with that investigated by the National Police. Therefore, the analysis of the provisions of the abovementioned laws of Ukraine indicates to the possibility of transfer of materials and/or criminal cases from the departments of the National Police to the units of the NBI and the SSU, and the transfer of materials from the subdivisions of the NBI to units of the SSU. Taking into account the relatively small number of employees in the central and regional departments of the NBI (1,500 employees), as well as the first results and activity of their work, it was concluded that the NBI already has its own niche in the system of similar central executive agencies and should justify the expenditures of the State Budget for staff training and functioning.
