Досліджено сучасні тенденції розвитку господарського процесуального законодавства України в умовах адаптації до права Європейського Союзу. Обґрунтовано, що євроінтеграційні процеси зумовлюють його трансформацію не лише через оновлення окремих процесуальних інститутів, а насамперед через формування нової моделі правового регулювання, орієнтованої на забезпечення ефективного судового захисту. Аргументовано, що визначальною тенденцією сучасного розвитку господарського процесуального законодавства є посилення ролі принципу верховенства права. Встановлено, що ключовими напрямами розвитку є цифровізація господарського судочинства, забезпечення єдності судової практики, посилення активної процесуальної ролі суду та ролі Верховного Суду в формуванні сталої правозастосовної практики, а також функціональна імплементація європейських процесуальних стандартів у національне законодавство. Доведено, що адаптація господарського процесуального законодавства України до права Європейського Союзу має здійснюватися у функціональному вимірі та передбачати не лише вдосконалення окремих процесуальних норм, а й забезпечення їх узгодженості з матеріальним господарським законодавством.
The article is devoted to the study of current trends in the development of the commercial procedural legislation of Ukraine in the context of its adaptation to the law of the European Union, which necessitates reconsideration of its functional purpose, substantive content, and compliance with contemporary European standards of justice. It is substantiated that European inte-gration processes determine the transformation of commercial procedural legislation not only through the modernization of individual procedural institutions but above all through the formation of a new model of legal regulation aimed at ensuring effective judicial protection. Despite active legislative reforms and the continuous development of judicial practice, the process of adaptation remains fragmented, resulting in problems related to legal certainty, access to justice, consistency of judicial practice, the effectiveness of procedural mechanisms, and coherence between procedural and substantive law.
The purpose of the article is to identify the current trends in the development of the commercial procedural legislation of Ukraine under the conditions of adaptation to the law of the European Union and to determine their influence on the formation of a modern model of commercial justice.
The methodological framework of the study is based on the systemic-structural, comparative-legal, functional, for-mal-legal, and logical-legal methods, the application of which made it possible to comprehensively examine the trans-formation of commercial procedural legislation through the prism of European procedural standards, the case law of the European Court of Human Rights, and the Court of Justice of the European Union.
It is substantiated that the defining trend in the contemporary development of commercial procedural legislation is the strengthening of the role of the rule of law, which, in the procedural dimension, functions as an integrative criterion for asses-sing national legislation through a system of procedural standards (legal certainty, access to court, proportionality, adversarial proceedings, reasonable time for trial, and equality of the parties) as well as through the criterion of the effectiveness of judicial protection. It is established that the key directions of further development include the digitalization of commercial proceedings, the strengthening of the court’s active procedural role, ensuring the consistency of judicial practice, enhancing the role of the Supreme Court in the formation of stable judicial practice, and the functional implementation of European procedural standards into national legislation. The influence of the case law of the European Court of Human Rights and the Court of Justice of the European Union on the formation of the modern model of commercial procedural law has been analysed.
It is proved that the adaptation of the commercial procedural legislation of Ukraine to the law of the European Union should be carried out in a functional dimension and should involve not only the improvement of individual procedural provisions but also the establishment of a coherent system of procedural regulation based on European standards of justice, ensuring their consistency with substantive law and guaranteeing effective, fair, and predictable judicial protection of the rights and legitimate interests of participants in commercial legal relations.
