Дисертація присвячена комплексному дослідженню адміністративно-правових засад організаційного забезпечення роботи судів в Україні, визначенню проблем його нормативного та організаційного забезпечення та розробленню пропозицій з удосконалення національного законодавства у цій сфері.
В роботі здійснено комплексний історико-правовий аналіз становлення суб’єктів організаційного забезпечення роботи судів в Україні, який охоплює період від часів Київської Русі до сучасного етапу функціонування судової системи. Формування інституту організаційного забезпечення судової діяльності відбувалося поступово через еволюцію від окремих допоміжних посадових осіб до створення розгалуженої системи спеціалізованих органів. На першому етапі у судовій системі Київської Русі функціонували службовці з допоміжними функціями – мечник, вирник, метальник, ябедник, помічники в судових справах боярина (тіуни). За часів Великого князівства Литовського відбулася формалізація статусу помічників судді (підсудок і писар), введено посаду возного для забезпечення порядку в суді та виконання судових доручень. У період перебування в складі Австро-Угорщини значно розширився склад допоміжного персоналу, створювалися канцелярії судів з секретарями, протоколістами, реєстраторами, судовими виконавцями. Російський період характеризувався розвитком системи судових канцелярій на основі Устрою судових установлень 1864 року, встановленням високих кваліфікаційних вимог до основних посад канцелярії. Радянський період відзначався підпорядкуванням судів органам юстиції та мінімізацією ролі апарату суду.
Визначено, що сучасна модель організаційного забезпечення судів в Україні сформувалася внаслідок судових реформ 1992–2016 років і характеризується створенням професійного апарату суду як основного суб’єкта організаційного забезпечення, утворенням ДСА України як спеціалізованого органу в системі судової влади, функціонуванням ВРП як органу суддівського врядування з широкими повноваженнями у сфері кадрового та організаційного забезпечення. Обґрунтовано, що українська модель організаційного забезпечення судів відповідає європейському підходу, згідно з яким апарат здійснює виключно організаційне забезпечення діяльності суду, не виконуючи судових функцій.
Встановлено, що в теперішній час правове регулювання організаційного забезпечення роботи судів в України здійснюється актами міжнародного права (міжнародними договорами та конвенціями, ратифікованими Україною, та актами «м’якого права) та актами національного законодавства України. З точки зору визначення сутнісних властивостей зазначених правових актів важливо підкреслити наступне: 1)˚вказані правові акти характеризуються «полівалентністю» з огляду на їх призначення у механізмі правового регулювання, тобто ці акти одночасно входять до системи джерел конституційного, адміністративного, кримінального, фінансового, бюджетного, господарського законодавства; 2)˚вказані правові акти, маючи різну галузеву приналежність, містять правові приписи, які регулюють однорідні суспільні відносини – відносини щодо організації судової влади та здійснення правосуддя, що дає підстави визнати правове регулювання організаційного забезпечення діяльності судів міжгалузевим інститутом законодавства; 3) в системі досліджуваних правових актів все більш питомої ваги здобувають підзаконні правові акти та акти «м’якого права», що характеризує систему як недостатньо упорядковану; 4) існуючі класифікації вказаних правових актів мають своїми критеріями юридичну силу актів; предметну сферу застосування (внаслідок чого акти розподіляють на загальні та спеціальні); їх видавників (органи державної влади та органи суддівського самоврядування); історичні періоди здійснення в Україні судової реформи тощо.
Здійснено системний аналіз принципів організаційного забезпечення роботи судів в Україні та обґрунтовано їх багатовимірну класифікацію. Встановлено плюралістичний характер розуміння сутності принципів права у сучасному науковому дискурсі та відсутність загальновизнаних критеріїв систематизації принципів судової влади. Виявлено, що організаційне забезпечення роботи судів як міжгалузевий правовий інститут базується на системі взаємопов’язаних правових принципів. Обґрунтовано застосування багатовимірної класифікації принципів організаційного забезпечення роботи судів, яка включає вертикально-інтегровані та горизонтально-інтегровані принципи. Підсистема вертикально-інтегрованих принципів охоплює правові принципи, визначені різними джерелами права України відповідно до їх юридичної чинності та ієрархічного зв’язку. Підсистема горизонтально-інтегрованих принципів включає самостійні, але взаємопов’язані блоки принципів кадрового, матеріально-технічного, інформаційного та фінансового забезпечення. Систематизовано конституційні принципи організаційного забезпечення: територіальність, спеціалізація, інстанційність, незалежність суддів, єдність судової системи, фінансування судів виключно з Державного бюджету. Виокремлено принципи фінансового забезпечення: гарантованість, збалансованість, обґрунтованість, паритетність, захищеність видатків. Визначено принципи інформаційного забезпечення: електронне діловодство, централізоване зберігання, захищене зберігання, автоматизація, безоплатна реєстрація. Охарактеризовано принципи кадрового забезпечення: прозорість добору, змагальність, професійна компетентність, доброчесність, залучення громадськості. Встановлено принципи матеріально-технічного забезпечення: комп’ютеризація судів, безпека, архітектурна доступність, клієнтоорієнтованість. Обґрунтовано доцільність розмежування принципів нормативно визначених та імпліцитних, що формулюються на підставі правової доктрини та судової практики.
Зроблено висновок про комплексний та багатоаспектний характер функцій організаційного забезпечення роботи судів в Україні. Система функцій організаційного забезпечення включає функції фінансового, матеріально-технічного, кадрового, інформаційного та організаційно-технічного характеру. За спрямованістю доцільно розмежовувати соціально-орієнтовані функції, що забезпечують реалізацію очікувань суспільства від належної організації роботи суду, та внутрішньо-орієнтовані функції, безпосередньо пов’язані з внутрішньо-системною організацією роботи судів. За часовими критеріями виокремлено стратегічні функції, спрямовані на досягнення довгострокових цілей судової реформи, та тактичні функції проміжного характеру.
Встановлено, що апарат суду є первинним і основним суб’єктом організаційного забезпечення роботи судів в Україні. Для усунення прогалини щодо відсутності офіційного визначення поняття «апарат суду» запропоновано його характеризувати як структурний підрозділ судів загальної юрисдикції, що являє собою систему управлінь та відділів, які здійснюють організаційне забезпечення роботи суду шляхом документування, забезпечення належного документообігу та технічного забезпечення судового процесу.
Обґрунтовано розмежування категорій «штат» і «персонал» апарату суду за функціональною ознакою. До штату включено професіоналів та кваліфікованих державних службовців, які здійснюють організаційне забезпечення роботи суду, а до персоналу - працівників, що виконують функції з обслуговування та робітників. Працівниками апарату суду є державні службовці, працівники патронатної служби, працівники з обслуговування та робітники.
Проаналізовано структуру апарату суду, яка включає керівника та його заступників, структурні підрозділи, прес-службу, канцелярію, бухгалтерську службу, службу управління персоналом, патронатну службу та службу судових розпорядників. Визначено специфіку правового статусу різних категорій працівників апарату та особливості їх підпорядкування, зокрема подвійне підпорядкування помічників суддів керівнику апарату та безпосередньо суддям.
Під час дослідження з’ясовано, що адміністративно-правовий статус працівників апарату суду характеризується складністю та неоднорідністю через різноманітність категорій працівників та їх функціональних обов’язків. Суттєвою проблемою є відсутність у чинному законодавстві чіткого визначення поняття «адміністративно-правовий статус працівників апарату суду» та вичерпного переліку осіб, які входять до складу апарату суду. Запропоновано визначення адміністративно-правового статусу працівників апарату суду як сукупності встановлених законом прав та обов’язків, спрямованих на належне забезпечення реалізації правосуддя.
Охарактеризовано особливості правового статусу керівника апарату суду та його заступників, включаючи специфіку призначення, звільнення, повноважень та відповідальності. Виявлено недоліки у кваліфікаційних вимогах до претендентів на ці посади, зокрема відсутність вимоги щодо спеціальності вищої освіти. Визначено правовий статус спеціалістів апарату суду, включаючи помічників суддів, секретарів судових засідань, судових розпорядників та інших категорій працівників.
Визначено, що система внутрішньої та зовнішньої взаємодії щодо організаційного забезпечення роботи судів в Україні є основним елементом ефективного функціонування судової системи. Утім вона характеризується недостатнім теоретико-правовим осмисленням та законодавчою неврегульованістю.
Запропоновано авторське визначення взаємодії щодо організаційного забезпечення роботи судів як систематичного взаємного впливу суб’єктів адміністративних повноважень один на одного задля досягнення спільної мети, спрямованої на створення та підтримання умов для ефективного здійснення судочинства. Визначено характерні ознаки такої взаємодії: наявність суб’єктів з владними повноваженнями, спільність мети, взаємовплив, організаційно-правова природа відносин та систематичний характер.
Розроблено класифікацію взаємодії за напрямом (зовнішня та внутрішня) та колом сторін. Зовнішня взаємодія реалізується через комунікаційну, інформаційну та організаційну функції державних органів судової влади з громадськістю, ЗМІ та іншими органами державної влади. Внутрішня взаємодія охоплює відносини між працівниками апарату суду, суддями та керівництвом.
На основі узагальнення позитивного зарубіжного досвіду організаційного забезпечення роботи судів встановлено, що він характеризується поступовим розмежуванням функцій судового адміністрування між суддями і апаратом суду, що сприяє підвищенню ефективності правосуддя та його клієнтоорієнтованості. Так, формування інституту судових адміністраторів у США та Канаді у 1960-1970-х роках стало відповіддю на потребу звільнення суддів від адміністративних функцій для зосередження на здійсненні правосуддя. У країнах ЄС реалізуються три основні моделі: повне покладення організаційних функцій на апарат суду (Польща, Естонія), часткове делегування судових повноважень працівникам апарату (Німеччина, Австрія з інститутом «rechtspfleger»), та поєднання функцій (Болгарія).
Визначено ключові напрями удосконалення організаційного забезпечення роботи судів з урахуванням зарубіжного досвіду: запровадження конкурсного відбору помічників суддів, створення посад типу «rechtspfleger», підвищення професіоналізму судових адміністраторів, звільнення суддів від адміністративних функцій, покращення технічного забезпечення та розвиток електронного судочинства.
Проведений аналіз перспектив удосконалення організаційного забезпечення роботи судів в Україні засвідчує, що реформування судової системи після конституційних змін 2016 року відбувається у напрямі імплементації європейських норм і практик, що сприяє підвищенню інституційної спроможності та самостійності суб’єктів організаційного забезпечення. Серед позитивних трансформацій слід виділити створення Єдиної судової інформаційно-телекомунікаційної системи, удосконалення взаємодії між ДСА України та ВРП у питаннях визначення кількісного складу суддів, а також запровадження нових підходів до кадрового забезпечення судової системи.
Водночас проблемними залишаються питання інституційного статусу та підзвітності ДСА України, розмежування повноважень між керівником апарату суду та головою суду, недостатнього рівня цифровізації судового адміністрування і судочинства, а також відсутності належної внутрішньої та зовнішньої взаємодії у системі організаційного забезпечення роботи судів. Особливої актуальності набувають виклики, пов’язані з функціонуванням судів в умовах воєнного стану, зокрема щодо належного врегулювання порядку тимчасового виконання обов’язків керівника апарату суду та здійснення окремих адміністративних повноважень голови суду за відсутності у суді суддів, які здійснюють правосуддя, керівника апарату суду та його заступника.
Оптимізація організаційного забезпечення роботи судів має здійснюватися шляхом запровадження єдиної системи оцінювання та управління ефективністю роботи судів, подальшого розвитку електронного правосуддя, удосконалення кадрового, матеріально-технічного та безпекового забезпечення судів, а також адаптації судової системи до європейських стандартів. Реалізація цих напрямів сприятиме підвищенню ефективності функціонування судової системи та зміцненню довіри суспільства до судової влади.
The dissertation is devoted to a comprehensive study of the administrative and legal principles of organizational support for the work of courts in Ukraine, identification of problems of its regulatory and organizational support and development of proposals for improving national legislation in this area.
The work carries out a comprehensive historical and legal analysis of the formation of the subjects of organizational support of the work of courts in Ukraine, covering the period from the times of Kyivan Rus to the modern stage of the functioning of the judicial system. The formation of the institution of organizational support of judicial activity took place gradually through the evolution from individual auxiliary officials to the creation of an extensive system of specialized bodies. At the first stage, employees with auxiliary functions functioned in the judicial system of Kyivan Rus - a swordsman, a thrower, a yabednik, assistants in judicial cases of the boyar (tiuns). During the time of the Grand Duchy of Lithuania, the status of assistants to the judge (the defendant and the clerk) was formalized, and the position of a porter was introduced to ensure order in the court and carry out court orders. During the period of its stay as part of Austria-Hungary, the composition of the auxiliary staff significantly expanded, and court offices with secretaries, protocolists, registrars, and bailiffs were created. The Russian period was characterized by the development of the system of court offices based on the 1864 Code of Judicial Institutions, establishing high qualification requirements for key office positions. The Soviet period was marked by the subordination of courts to justice authorities and the minimization of the role of the court apparatus.
It is determined that the modern model of organizational support of courts in Ukraine was formed as a result of the judicial reforms of 1992–2016 and is characterized by the creation of a professional court apparatus as the main subject of organizational support, the formation of the State Judicial Administration of Ukraine as a specialized body in the judicial system, the functioning of the Supreme Judicial Council as a judicial governance body with broad powers in the field of personnel and organizational support. It is substantiated that the Ukrainian model of organizational support of courts corresponds to the European approach, according to which the apparatus provides exclusively organizational support for the activities of the court, without performing judicial functions.
It has been established that at present the legal regulation of the organizational support of the work of courts in Ukraine is carried out by acts of international law (international treaties and conventions ratified by Ukraine, and acts of "soft law") and acts of national legislation of Ukraine. From the point of view of determining the essential properties of the specified legal acts, it is important to emphasize the following: 1) the specified legal acts are characterized by "polyvalence" in view of their purpose in the mechanism of legal regulation, that is, these acts are simultaneously included in the system of sources of constitutional, administrative, criminal, financial, budgetary, economic legislation; 2) the specified legal acts, having different branch affiliation, contain legal provisions that regulate homogeneous social relations - relations regarding the organization of the judiciary and the administration of justice, which gives grounds to recognize the legal regulation of the organizational support of the work of courts as an interdisciplinary institute of legislation; 3) in the system of legal acts under study, subordinate legal acts and acts of “soft law” are gaining more and more importance, which characterizes the system as insufficiently organized; 4) the existing classifications of the specified legal acts have as their criteria the legal force of the acts; the subject scope of application (as a result of which the acts are divided into general and special); their publishers (state authorities and judicial self-government bodies); historical periods of implementation of judicial reform in Ukraine, etc.
A systematic analysis of the principles of organizational support for the work of courts in Ukraine was carried out and their multidimensional classification was substantiated. The pluralistic nature of the understanding of the essence of the principles of law in modern scientific discourse and the absence of generally recognized criteria for systematizing the principles of judicial power were established. It was revealed that the organizational support for the work of courts as an interdisciplinary legal institution is based on a system of interconnected legal principles. The application of a multidimensional classification of the principles of organizational support for the work of courts, which includes vertically integrated and horizontally integrated principles, was substantiated. The subsystem of vertically integrated principles covers legal principles defined by various sources of Ukrainian law in accordance with their legal validity and hierarchical relationship. The subsystem of horizontally integrated principles includes independent but interconnected blocks of principles of personnel, material and technical, informational and financial support. The constitutional principles of organizational support are systematized: territoriality, specialization, jurisdiction, independence of judges, unity of the judicial system, financing of courts exclusively from the State Budget. The principles of financial support are identified: guarantee, balance, justification, parity, protection of expenses. The principles of information support are determined: electronic record keeping, centralized storage, protected storage, automation, free registration. The principles of personnel support are characterized: transparency of selection, competition, professional competence, integrity, public involvement. The principles of material and technical support are established: computerization of courts, security, architectural accessibility, client-orientedness. The expediency of distinguishing between normatively defined and implicit principles, which are formulated on the basis of legal doctrine and judicial practice, is substantiated.
The conclusion is made about the complex and multifaceted nature of the functions of organizational support of the work of courts in Ukraine. The system of organizational support functions includes functions of a financial, material and technical, personnel, informational and organizational and technical nature. By orientation, it is advisable to distinguish between socially-oriented functions that ensure the implementation of society's expectations from the proper organization of the work of the court, and internally-oriented functions that are directly related to the intra-system organization of the work of the courts. By time criteria, strategic functions aimed at achieving long-term goals of judicial reform and tactical functions of an intermediate nature are distinguished.
It has been established that the court apparatus is the primary and main subject of organizational support for the work of courts in Ukraine. To eliminate the gap in the absence of an official definition of the concept of "court apparatus", it is proposed to characterize it as a structural unit of courts of general jurisdiction, which is a system of departments and departments that provide organizational support for the work of the court through documentation, ensuring proper document flow and technical support for the judicial process.
The distinction between the categories of "staff" and "personnel" of the court apparatus on a functional basis is justified. The staff includes professionals and qualified civil servants who provide organizational support for the work of the court, and the personnel includes employees performing service functions and workers. Employees of the court apparatus are civil servants, patronage service employees, service employees and workers.
The structure of the court apparatus, which includes the head and his deputies, structural units, press service, office, accounting service, personnel management service, patronage service and court bailiffs service, was analyzed. The specifics of the legal status of various categories of staff and the features of their subordination were determined, in particular, the dual subordination of assistant judges to the head of staff and directly to judges.
During the study, it was found that the administrative and legal status of court staff is characterized by complexity and heterogeneity due to the variety of categories of employees and their functional responsibilities. A significant problem is the lack of a clear definition of the concept of “administrative and legal status of court staff” and an exhaustive list of persons who are part of the court staff in the current legislation. It is proposed to define the administrative and legal status of court staff as a set of rights and obligations established by law, aimed at properly ensuring the implementation of justice.
The features of the legal status of the head of the court staff and his deputies are described, including the specifics of appointment, dismissal, powers and responsibilities. Deficiencies in the qualification requirements for applicants for these positions are identified, in particular the lack of a requirement for a higher education specialty. The legal status of court staff specialists is determined, including assistant judges, court secretaries, court bailiffs and other categories of employees.
It is determined that the system of internal and external interaction regarding the organizational support of the work of courts in Ukraine is a key element of the effective functioning of the judicial system, but is characterized by insufficient theoretical and legal understanding and legislative lack of regulation.
The author's definition of interaction regarding the organizational support of the work of courts is proposed as a systematic mutual influence of subjects of administrative authority on each other in order to achieve a common goal aimed at creating and maintaining conditions for the effective implementation of justice. The characteristic features of such interaction are identified: the presence of subjects with power, common goals, mutual influence, organizational and legal nature of relations, and systematic nature.
A classification of interaction by direction (external and internal) and the circle of parties has been developed. External interaction is implemented through the communication, information and organizational functions of state judicial authorities with the public, the media and other state authorities. Internal interaction covers relations between court staff, judges and management.
Based on the generalization of foreign experience in organizational support of the work of courts, it has been established that it is characterized by a gradual separation of judicial administration functions between judges and the court staff, which contributes to increasing the efficiency of justice and its client-orientedness. Thus, the formation of the institute of court administrators in the USA and Canada in the 1960s-1970s was a response to the need to free judges from administrative functions in order to focus on the administration of justice. Three main models are implemented in EU countries: full assignment of organizational functions to the court staff (Poland, Estonia), partial delegation of judicial powers to staff members (Germany, Austria with the “rechtspfleger” institute), and combination of functions (Bulgaria). Key areas for improving the organizational support of the work of courts, taking into account foreign experience, have been identified: the introduction of competitive selection of assistant judges, the creation of “rechtspfleger”-type positions, increasing the professionalism of court administrators, releasing judges from administrative functions, improving technical support, and developing e-judicial proceedings.
The analysis of the prospects for improving the organizational support of the work of courts in Ukraine shows that the reform of the judicial system after the constitutional changes of 2016 is taking place in the direction of implementing European norms and practices, which contributes to increasing the institutional capacity and independence of the subjects of organizational support. Among the positive transformations, the creation of the Unified Judicial Information and Telecommunications System should be highlighted, the improvement of interaction between the State Judicial Administration of Ukraine and the Supreme Court of Justice in matters of determining the quantitative composition of judges, as well as the introduction of new approaches to staffing the judicial system. At the same time, the issues of subordination of the State Judicial Administration of Ukraine, the separation of powers between the head of the court staff and the court president, the insufficient level of digitalization of court administration and judicial proceedings, as well as the lack of an appropriate communication policy in the judicial system remain problematic. Challenges related to the functioning of courts under martial law are becoming particularly urgent, in particular regarding the proper regulation of the procedure for the temporary performance of the duties of the head of the court staff and certain administrative powers of the court president in the absence of judges administering justice, the head of the court staff and his deputy.
The optimization of the organizational support of the work of the courts should be carried out by introducing a unified system for assessing and managing the efficiency of the work of the courts, further developing e-justice, improving the system for assessing the quality of the work of the courts, and adapting the judicial system to European standards. The implementation of these areas will contribute to increasing the efficiency of the functioning of the judicial system and strengthening public trust in the judiciary.
