Зазначено, що потреба в усуненні прогалин у праві викликає необхідність застосування правил аналогії закону та аналогії права. Оскільки близько 90 відсотків нормативних актів в Україні, рівно як і в інших державах, у більшій чи меншій мірі належать до актів господарського законодавства та врегульовують відносини в економіці, то усунення таких прогалин має бути покладено на систему господарського судочинства.
Вірне застосування правил аналогії закону та аналогії права сприятиме цьому. Проте більш ефективним з боку держави буде намагатися усувати прогалини у праві не стільки через застосування аналогії судами, а скільки через внесення змін до норм у законодавстві та доповнення останнього новими нормами і скасування норм та актів, які прогалини у праві штучно породжують. Зокрема, Закон України «Про особливості регулювання діяльності юридичних осіб окремих організаційно-правових форм у перехідний період та об’єднань юридичних осіб» запропоновано скасувати, допоки він не «наплодив» прогалин у праві.
It is noted that the need to eliminate gaps in the law necessitates the application of the rules of analogy of law. Since about 90 percent of regulatory acts in Ukraine, as in other states, to a greater or lesser extent belong to acts of economic legislation and regulate relations in the economy, the elimination of such gaps should be entrusted to the economic judicial system.
The correct application of the rules of analogy of law will contribute to this. However, it will be more effective for the state to try to eliminate gaps in the law not so much through the application of analogy by the courts, but rather through amendments to the norms in the legislation and the addition of the latter with new norms and the abolition of norms and acts that artificially generate gaps in the law. In particular, the Law of Ukraine “On the Peculiarities of Regulation of the Activities of Legal Entities of Certain Organizational and Legal Forms in the Transitional Period and Associations of Legal Entities” is proposed to be repealed until it “fertilizes” gaps in the law.
