У дисертації досліджено теоретичні та прикладні аспекти проведення медіації при здійсненні цивільного судочинства в Україні шляхом послідовного розкриття її поняття, правової природи, інституційного й суб’єктного наповнення, а також особливостей процесуальної діяльності, пов’язаної з проведенням медіації в спорах, що одночасно розглядаються в порядку цивільного судочинства. Враховуючи ухвалення Закону України «Про медіацію» (2021 р.) й внесення у зв’язку з цим відповідних змін до ЦПК України, робота передбачає насамперед осмислення співвідношення й взаємозв’язку між медіацією та цивільним судочинством, визначення потенціалу медіації в цивільних справах, що розглядаються судом, меж її проведення, а також встановлення недоліків відповідних актів чинного законодавства України та практики його застосування.
Об’єктом дослідження є суспільні відносини у сфері захисту прав, свобод та інтересів фізичних і юридичних осіб шляхом медіації при здійсненні цивільного судочинства. Предмет дослідження становлять особливості проведення медіації при здійсненні цивільного судочинства. Мета дисертаційного дослідження полягає у з’ясуванні теоретичних і практичних аспектів проведення медіації під час розгляду цивільних справ судами, формуванні концептуального розуміння цієї процедури в контексті її взаємодії з цивільним судочинством та обґрунтуванні пропозицій щодо вдосконалення чинного законодавства і судової практики.
У першому розділі, що складається з трьох підрозділів, розкрито методологічно-теоретичні засади дослідження медіації в контексті цивільного процесу. Окреслено методологічні підходи, що були застосовані при дослідженні медіації як правового явища, зокрема: діалектичний, діяльнісний, системний, синергетичний, феноменологічний, герменевтичний. Розкрито основні методи дослідження. Проведено огляд наявних у юридичній доктрині поглядів на медіацію та її взаємозв’язок із судочинством, зокрема цивільним. Показано, що медіація й цивільне судочинство утворюють взаємодоповнювальну систему вирішення юридичних спорів. Автор доводить, що розуміння медіації як правової процедури має ґрунтуватися на її правовій природі та принципах, а не лише на етичних або психологічних аспектах.
У цьому ж розділі на підставі виокремлення й аналізу ознак сформульовано дефініцію медіації при здійсненні цивільного судочинства як врегульованого законодавством, добровільного, конфіденційного та структурованого позасудового врегулювання спору про право чи про застосування превентивних заходів захисту між сторонами цивільної справи, яка перебуває на розгляді суду, що проводиться за участю нейтрального посередника (медіатора) з метою досягнення взаємоприйнятного рішення за сприяння суду, який зупиняє провадження у справі, а результатом може бути як мирне врегулювання спору з ухваленням відповідного судового рішення, так і продовження судового розгляду у разі недосягнення сторонами домовленості. З’ясовано, що медіація в умовах судового процесу дещо відрізняється від звичайної медіації, що проводиться незалежно від наявності провадження у цивільній справі, як за процедурою, так і за правовими наслідками. У дисертації виокремлено спільні та відмінні риси, а також переваги й недоліки медіації при здійсненні цивільного судочинства та судової процедури врегулювання спору за участю судді.
Другий розділ, що містить три підрозділи, присвячено інституційним засадам медіації при здійсненні цивільного судочинства. У ньому деталізовано предмет медіації, який визначено як медіабельний спір, що розглядається судом у порядку позовного провадження в цивільному судочинстві з можливістю розширення за рахунок включення сторонами інших питань, які не стосуються предмета спору. Такий спір може стосуватись як порушень прав, свобод та інтересів, так і їх превентивного захисту. Досліджено взаємозв’язок принципів цивільного процесуального права та медіації. При цьому з’ясовано, що попри відмінності у правовій природі, при проведенні медіації під час здійснення цивільного судочинства тісно переплітаються й впливають одна на одну система загальних засад цивільного судочинства та принципів медіації.
Особливу увагу приділено суб’єктному складу учасників медіації. Встановлено, що учасниками медіації під час цивільного судочинства є особи, які беруть участь і в судовому розгляді відповідної справи, і в процедурі врегулювання спору шляхом медіації. Суд виступає суб’єктом, який сприяє медіації, але не є її учасником. Автор визначає статус медіатора як учасника медіації, який є нейтральною особою, що забезпечує комунікацію між сторонами. Запропоновано концепцію створення медіаційних центрів при судах (але поза їх структурою), які б об’єднували незалежних від судової влади медіаторів і забезпечували практичне проведення медіації в цивільних справах. Доведено, що для їх ефективної діяльності необхідно на законодавчому рівні запровадити обов’язкову досудову медіацію в окремих категоріях спорів, які є найбільш медіабельними, встановити критерії платного та безоплатного проведення медіації, а також створити організаційні й процесуальні засади взаємодії суддів і медіаторів, які б дозволяли суддям сприймати такі медіаційні центри як невід’ємний елемент загальної системи правового захисту прав, свобод та інтересів осіб.
Третій розділ дисертації, що включає два підрозділи, зосереджено на аналізі процесуальних особливостей проведення медіації під час цивільного судочинства. Визначено стадії цивільного судочинства, на яких може проводитись медіація, та процесуальні форми її супроводу судом. Виокремлено три групи пов’язаних із медіацією судових рішень: а) ухвали про роз’яснення сторонам можливості примирення; б) ухвали щодо руху справи у зв’язку з медіацією; в) судові рішення, що фіксують результат позитивної медіації (ухвали, якими закінчується розгляд справи за результатами медіації, та рішення суду, ухвалене на підставі визнання відповідачем позову).
Автором проаналізовано проблематику неналежного процесуального врегулювання процедури медіації у ЦПК України, зокрема. відсутність чіткого порядку ініціювання медіації, критеріїв медіабельності спорів, процесуальних наслідків недобросовісного ухилення від участі в медіації, проблеми забезпечення виконання досягнутих домовленостей. Обґрунтовано недоцільність застосування перерви в підготовчому засіданні як процесуальної форми сприяння медіації. Натомість запропоновано запровадити єдиний спосіб надання учасникам справи часу для врегулювання їх спору шляхом медіації – зупинення провадження у справі.
Значну увагу приділено мировій угоді як позитивному результату медіації. Розглянуто її зміст, форму та процесуальні наслідки. Шляхом виокремлення спільних і відмінних рис автор співвідніс і розмежував мирову угоду та угоду за результатами медіації, що укладається відповідно до Закону України «Про медіацію». Запропоновано розглядати мирову угоду як процесуальну угоду й процесуальний акт, що за відповідності закону та дотримання прав інших осіб підлягає затвердженню судом і завершує провадження у справі.
У висновках дисертації сформульовано низку теоретичних положень та пропозицій щодо вдосконалення чинного законодавства України в частині врегулювання медіації при здійсненні цивільного судочинства, зокрема щодо впровадження елементів присудової медіації, запровадження обов’язкової медіації у договірних спорах, сторони яких передбачили в договорі медіацію як обов’язковий досудовий спосіб їх врегулювання, а також уточнення деяких положень ЦПК України.
In this dissertation studied the theoretical and applied aspects of conducting mediation in the administration of civil justice in Ukraine by consistently examining its concept, legal nature, institutional and subject composition, as well as the procedural specifics of mediation in disputes simultaneously considered within civil court proceedings. Taking into account the adoption of the Law of Ukraine “On Mediation” (2021) and the respective amendments to the Civil Procedure Code of Ukraine, the work primarily aims to comprehend the relationship and interaction between mediation and civil procedure, to define the potential of mediation in civil cases heard by courts, the limits of its application, and to identify deficiencies in the relevant legislation and its practical implementation.
The object of the study is the social relations in the field of protecting the rights, freedoms, and interests of individuals and legal entities through mediation during civil proceedings. The subject of the study is the specific features of conducting mediation in the administration of civil justice. The purpose of the dissertation is to clarify the theoretical and practical aspects of mediation in civil proceedings, to form a conceptual understanding of this procedure in its interaction with civil justice, and to substantiate proposals for improving current legislation and judicial practice.
The first chapter, consisting of three sections, reveals the methodological and theoretical foundations of the study of mediation in the context of civil procedure. It outlines the methodological approaches applied in the study of mediation as a legal phenomenon, including dialectical, activity-based, systemic, synergetic, phenomenological, and hermeneutical approaches. The main research methods are described. A review of existing views in legal doctrine on mediation and its relationship with court proceedings, in particular civil ones, is provided. It is demonstrated that mediation and civil procedure form a complementary system for resolving legal disputes. The author argues that understanding mediation as a legal procedure must be based on its legal nature and principles, not merely on ethical or psychological aspects.
In the same chapter, based on the identification and analysis of key features, a definition of mediation in civil procedure is formulated as a legally regulated, voluntary, confidential, and structured out-of-court settlement of a legal dispute or dispute over the application of preventive protection measures between parties to a civil case pending before a court, conducted with the participation of a neutral third party (mediator) for the purpose of reaching a mutually acceptable solution, with the assistance of the court, which suspends the proceedings. The outcome may be either an amicable settlement of the dispute with a respective court decision or continuation of court proceedings if the parties fail to reach an agreement. It is established that mediation in the context of court proceedings differs from general mediation conducted independently of a court case both in procedure and legal consequences. The dissertation identifies common and distinct features, as well as the advantages and disadvantages of mediation in civil proceedings compared to the judicial procedure of dispute resolution with the participation of a judge.
The second chapter, which includes three sections, is devoted to the institutional foundations of mediation in civil proceedings. It details the subject matter of mediation, defined as a mediable dispute being considered by the court under the general procedure of a civil action, with the possibility of expanding the scope to include other issues not directly related to the subject matter of the case. Such a dispute may concern violations of rights, freedoms, and interests, as well as their preventive protection. The relationship between the principles of civil procedure and mediation is examined. It is found that despite differences in legal nature, the systems of principles in civil procedure and mediation are closely intertwined and influence one another in the course of mediation during civil proceedings.
Special attention is given to the composition of participants in mediation. It is established that the participants in mediation during civil proceedings are the same persons involved in the corresponding court case and in the dispute resolution procedure through mediation. The court acts as a facilitating authority but is not a participant in the mediation. The author defines the status of the mediator as a neutral person who facilitates communication between the parties. A concept is proposed for the establishment of mediation centers at courts (outside their institutional structure) to unite independent mediators and ensure the practical implementation of mediation in civil cases. It is argued that for such centers to function effectively, legislative changes are needed to introduce mandatory pre-trial mediation in specific categories of the most mediable disputes, to establish criteria for paid and free mediation services, and to create organizational and procedural foundations for the interaction of judges and mediators, enabling judges to perceive such mediation centers as an integral part of the legal system for protecting rights, freedoms, and interests.
The third chapter of the dissertation, which consists of two sections, focuses on the procedural features of conducting mediation during civil proceedings. It identifies the stages of civil procedure at which mediation may take place and the procedural forms of its support by the court. Three groups of court decisions related to mediation are distinguished: a) decisions to explain the possibility of reconciliation to the parties; b) rulings regarding the progress of the case in connection with mediation; c) judicial decisions that formalize the positive result of mediation (rulings concluding the proceedings after successful mediation, and judgments based on the defendant’s admission of the claim).
The author analyzes the challenges of inadequate procedural regulation of mediation in the Civil Procedure Code of Ukraine, including the lack of a clear procedure for initiating mediation, criteria for mediability of disputes, legal consequences of bad-faith refusal to participate in mediation, and issues related to enforcing the agreements reached. The inadequacy of using a break in the preparatory hearing as a form of facilitating mediation is substantiated. Instead, it is proposed to introduce a unified method of granting parties time to settle their dispute through mediation by suspending the court proceedings.
Considerable attention is paid to the settlement agreement as a result of successful mediation. Its content, form, and procedural implications are examined. By distinguishing common and distinct features, the author compares and differentiates the settlement agreement from the agreement resulting from mediation under the Law of Ukraine "On Mediation". It is proposed to treat the settlement agreement as both a procedural agreement and a procedural act, which, if compliant with the law and respecting the rights of other persons, is subject to court approval and concludes the proceedings.
In conclusion, the dissertation formulates a number of theoretical findings and proposals aimed at improving current Ukrainian legislation regarding the regulation of mediation during civil proceedings. This includes the introduction of elements of court-connected mediation, mandatory mediation in contractual disputes where the parties have agreed on it as a pre-trial settlement method, and refinement of certain provisions of the Civil Procedure Code of Ukraine.
