Міжнародні інституційні арбітражі: специфічні риси та види

Abstract

Стаття присвячена аналізу природи, сутності та специфічних рис міжнародних інститу-ційних арбітражів, а також їх різновидів. Авторами акцентується увага на тому, що нині існує брак наукових досліджень у цій площині. Натомість, виходячи із попиту на вирішення комерційних спорів саме у межах міжнародних комерційних арбітражних інституцій-них арбітражах та центрах, такі дослідження є об’єктивно обумовленими та доречними. Обґрунтовано, що специфічними рисами інституційного арбітражу є: являється недержавною установою; метою створення та функціонування є надання суб’єктам міжнародних комерційних відносин послуг з вирішення спорів; наявність постійно діючого адміністративного органу, що виконує також технічні, консультативні та контрольні функції; наявність власних правил процедури (статути, регламенти); функціонування в правовому полі, яке утворюється відповідним законодавством про арбітраж країни їх місця знаходження, нормами міжнародних договорів, угод, конвенцій та згідно з регламентом; створюється при різних комерційних організаціях, торговельних та торгово-промислових палатах різних країн, різних товарних асоціаціях, біржах, банківських асоціаціях тощо; як правило, є юридичною особою відповідно до законодавства країни місця створення та розташування. Робиться висновок про те, що в силу інтенсивного розвитку взаємовигідного співробітництва в сфері міжнародної торгівлі останнім часом відчувається попит серед комерсантів у наявності саме спеціалізованих інституційних арбітражних установ, які можуть забезпечити більш якісний та ефективний арбітраж.

The article is devoted to the analysis of the nature, essence and specific features of international institutional arbitrations, as well as their varieties. The authors draw attention to the fact that currently there is a lack of scientific research in this area. Instead, based on the demand for the resolution of commercial disputes within the framework of international commercial arbitration institutional arbitrations and centers, such studies are objectively determined and relevant. It is substantiated that the specific features of institutional arbitration are: it is a non-state institution; the purpose of creation and operation is to provide dispute resolution services to subjects of international commercial relations; the presence of a permanent administrative body that also performs technical, advisory and control functions; the presence of own rules of procedure (statutes, regulations); functioning in the legal field, which is formed by the relevant legislation on arbitration of the country of their location, the norms of international treaties, agreements, conventions and in accordance with the regulations; is created by various commercial organizations, trade and commerce and industry chambers of various countries, various commodity associations, stock exchanges, banking associations, etc.; as a rule, is a legal entity under the laws of the country of creation and location. It is concluded that due to the intensive development of mutually beneficial cooperation in the field of international trade, there has recently been a demand among businessmen for specialized institutional arbitration institutions that can provide higher quality and effective arbitration.
