dc.description.abstract У статті аналізується cпецифіка правового статусу науково-педагогічних працівників, яка полягає в тому, що вони проходять процедуру конкурсу на заміщення вакантної посади; мають скорочену тривалість робочого часу; підлягають періодичній атестації; працюють, як правило, за строковим трудовим контрактом; зобов’язані проходити періодичне підвищення кваліфікації та стажування. uk_UA
dc.description.abstract The author analyzes the legal relationship between professor and educational institution that has certain specificity. The legal personality of a scientific and pedagogical worker is regulated by the norms of educational, administrative, labor law, but the main role belongs to the norms of civil law. It has been grounded that the norms regulating labour relations are civil and legal by the juridical essence, since the manpower more and more acquires commodity character with the transition to the market economy, gradually the bound between civil and labour law evanesces, the number of civil and legal elements increases, being used during the regulation of labour relations. The article discusses the specificity of the legal status of research and teaching staff (which distinguishes them from employees in other areas) is that they pass the competition procedure to fill a position; have reduced working hours; subject to periodic certification; work, as a rule, under a fixed-term employment contract; are required to undergo periodic refresher training and internships. These features of the legal status allow the university administration to carefully select research and teaching staff and provide teaching only by highly qualified specialists. It has been suggested to conclude tenure with the particular representatives of the academic staff that would promote valuable realization of the right to the academic freedom of the professor. The article highlights that the benefits of introducing tenure for university professor in Ukraine far outweigh the possible negative consequences. The legal status of Ukrainian research and teaching staff is determined at the regulatory level by the Cabinet of Ministers of Ukraine; central executive body in the field of education and science; branch state bodies, the sphere of management of which includes institutions of higher education. At the same time, American universities have the right to independently, at the local level, determine the legal status of American professors, which indicates the effective implementation of institutional autonomy, in particular its component such as personnel autonomy uk_UA
